INTRODUÇÃO
Tendo sido registados, ao longo dos últimos anos, em diversos lugares do mundo
incidentes de segurança alimentar de maior relevância, a preocupação de segurança
alimentar torna-se cada vez mais notória. Neste contexto, o Governo da RAEM criou,
em 2008, o “Grupo de Coordenação sobre a segurança dos produtos alimentares” que
visa coordenar a fiscalização da segurança dos produtos alimentares e tomar medidas
oportunas e adequadas em resposta às eventuais situações de emergência desta natureza.
Embora a legislação vigente em Macau e o regime de fiscalização e controlo no âmbito
de segurança alimentar sejam bastante eficazes, ao passo que a preocupação de
segurança alimentar se torna cada vez mais notória, têm vindo a surgir problemas
relativos à dispersão das disposições legais e das competências e à sobreposição e
espaços vazios nas atribuições de supervisão. Em cumprimento das instruções do Chefe
do Executivo, a Direcção dos Serviços de Assuntos de Justiça, o Instituto para os
Assuntos Cívicos e Municipais e demais serviços funcionais procedem à produção
jurídica de uma lei de bases com vista a uma aplicação englobante sobre a segurança
alimentar, de modo a integrar as actuais normas de segurança alimentar num diploma
mediante este processo legiferente, bem como aperfeiçoar o sistema regulador nesta
matéria, introduzindo nele os três aspectos chave para a garantia de segurança alimentar,
i.e., avaliação, gestão e comunicação de riscos, tendo como referência as directrizes da
Organização das Nações Unidas para a Alimentação e a Agricultura e da Organização
Mundial de Saúde e as experiências do Interior da China, Hong Kong e Singapura na
legislação sobre esta matéria.

Nestes termos, a Direcção de Serviços de Assuntos de Justiça e o Instituto para os
Assuntos Cívicos e Municipais apresentam o documento de consulta da Lei de
Segurança Alimentar, para auscultar as opiniões e sugestões dos diversos sectores da
sociedade tendentes a aperfeiçoar o regime jurídico da segurança alimentar, podendo os
interessados, através de qualquer dos meios abaixo indicados, aceder ao documento de
consulta e apresentar as suas opiniões ou sugestões sobre o presente documento de
consulta e outras matérias que cuidem merecerem de ser atendidas na elaboração da lei,
sugestões e opiniões essas que poderão ser apresentadas no período compreendido entre
1 de Novembro e 16 de Dezembro de 2011.
Finda a consulta, iremos apresentar e publicar um relatório final com base nas
opiniões e sugestões recolhidas. Caso pretenda manter a confidencialidade da sua

I. Contexto da elaboração da Lei de Segurança Alimentar
No que respeita à fiscalização e controlo da segurança alimentar, em Macau como
em muitos países e regiões, adopta-se o método de divisão do trabalho e sinergia entre
os diversos serviços públicos, cabendo aos Serviços de Saúde, ao Instituto para os
Assuntos Cívicos e Municipais (IACM), à Direcção dos Serviços de Turismo (DST), à
Direcção dos Serviços de Economia (DSE) etc. assegurar a segurança alimentar e sendo,
assim, relativamente dispersas as competências de fiscalização e controlo dos géneros
alimentícios. Como por exemplo, compete à DST 1

encontram dispersas em vários diplomas legais de Macau, tais como O Código Penal
(Artigo 269.º), Decreto-Lei n.º 50/92/M, «Lei de Rotulagem dos Géneros Alimentícios»,
o licenciamento e a ulterior
fiscalização dos restaurantes, cabendo ao IACM a supervisão sobre os estabelecimentos
de comidas e bebidas, mercados de vegetais e vendedores ambulantes e à DSE a
superintendência dos estabelecimentos industriais de produção e transformação de
géneros alimentícios e, ainda, a fiscalização da rotulagem dos géneros alimentícios. Sem
necessidade de processo prévio, administrativo ou judicial, os Serviços de Saúde podem
tomar as medidas indispensáveis à prevenção ou à eliminação de factores ou situações
susceptíveis de pôr em risco ou causar prejuízos à saúde individual ou colectiva.

que estabelece os nomes específicos dos aditivos alimentares genéricos.
Existe em Macau um conjunto de actos normativos sobre a produção, importação,
transporte, circulação e fornecimento dos géneros alimentícios, que servem de base aos
serviços competentes para efectuarem as acções de controlo da segurança alimentar
conforme as suas respectivas atribuições. Acontece, porém, que, com as exigências cada
vez mais elevadas da segurança alimentar por parte da população em geral, vêm
surgindo paulatinamente problemas nas diversas áreas não cabalmente supervisionadas
pelas leis vigentes. A título exemplificativo, a legislação vigente regulamenta, mediante
o regime de licenciamento, os estabelecimentos fornecedores de comidas, tais como
restaurantes e casas de pasto, mas, até à data ainda não existem serviços públicos
incumbidos de supervisionar os problemas da qualidade das comidas disponibilizadas
pelos estabelecimentos de fornecimento de comidas para fora – “tipo take-away”. Além
disso, constata-se uma insuficiência no actual regime de regulamentação em certas
matérias, tais como a normalização da segurança alimentar, competência de inspecção
de géneros alimentícios, medidas específicas caso surjam incidentes de segurança
alimentar.

Devido à dispersão das disposições legais vigentes relativas à segurança alimentar e
à falta de um conjunto de disposições legais sistematizadas e basilares da segurança
alimentar, o Governo da RAEM encetou os trabalhos prévios do elaboração da Lei da
segurança alimentar, tendo sido efectuados estudos de direito comparativo sobre as
legislações do Interior da China, Hong Kong, Singapura e Macau relativas à segurança
alimentar 2 e consultados instrumentos internacionais, incluindo a «Garantia da
Segurança e Qualidade dos Alimentos: Manuais para fortalecimento dos sistemas
nacionais de controlo dos alimentos» promulgado, em 2003, pela Organização das
Nações Unidas para a Alimentação e a Agricultura e Organização Mundial de Saúde3
Quanto à fiscalização e controlo da segurança alimentar, atendendo ao facto de que
as competências estão atribuídas a vários serviços públicos devido, havendo carência de
uniformidade no plano de execução da lei, o que contribui para a eventual diminuição
da eficácia na fiscalização e controlo da segurança alimentar, a Lei de Segurança
Alimentar em projecto definirá novamente o sistema de controlo da segurança alimentar,
atribuindo ao Instituto para os Assuntos Cívicos e Municipais (IACM) os poderes que
não estejam especialmente previstos na lei vigente e que envolvam exames, inspecção,
recolha de amostras e análises dos géneros alimentícios e a aplicação de multas para
(adiante designado por Manuais). Com base disso, foi elaborado o projecto de Lei de
Segurança Alimentar, que visa colmatar a insuficiência na regulamentação actual, e
eliminando espaços jurídicos vários nas áreas do controlo da segurança alimentar.

casos de infracção, cabendo ao IACM direcção das acções de fiscalização e controlo e
aos demais serviços públicos a colaboração na execução da lei em prol da segurança
alimentar de Macau.
A Organização das Nações Unidas para a Alimentação e a Agricultura e a
Organização Mundial de Saúde apresentou, através dos supracitados Manuais, uma série
de propostas tendentes à instituição do sistema de garantia da segurança alimentar e à
elaboração dos respectivos diplomas legais, diplomas esses que devem conter os três
aspectos chave: avaliação, gestão e comunicação de riscos. A avaliação de risco consiste
essencialmente em um processo científica de estimação dos efeitos adversos dos
géneros alimentícios falsificados ou contaminados à saúde do corpo humano, através de
recolha de amostras e análises dos géneros alimentícios disponibilizados no mercado,
assim como caracterização dos riscos derivados dos géneros inseguros e constituição de
uma base científica destinada à formulação de normas da segurança alimentar e à
adopção das medidas de gestão dos riscos. A gestão de riscos constitui um processo em
que os serviços competentes adoptam medidas de prevenção e controlo sobre os géneros
alimentícios com riscos, tendo em conta os resultados da avaliação de risco, meios de
protecção da saúde do consumidor, efeitos sobre as actividades comerciais e outros
factores. A comunicação de risco refere-se ao processo de troca ou intercâmbio de
informações com os serviços públicos competentes e as organizações internacionais
quanto à gestão de segurança alimentar e a atempada divulgação ao público das
informações sobre os riscos de segurança alimentar e a prevenção dos incidentes.

Com efeitos, quando o Interior da China, Hong Kong e Singapura procederam à
legislação de segurança alimentar, acolheram, em diferentes graus, as propostas dos
Manuais, tendo consagrado os três aspectos chave supracitados nos diplomas legais,
como por exemplo, a Lei de Segurança Alimentar do Interior da China dispõe
claramente que o Estado deve proceder ao estabelecimento do regime de avaliação de
riscos na segurança alimentar relativos aos riscos biológicos, químicos e físicos nos
alimentos e nos aditivos alimentares, definição das normas de segurança alimentar,
instituição do plano de gestão de emergências para a segurança alimentar, etc. A
legislação de Hong Kong «Public Health and Municipal Services Ordinance» dispõe
expressamente sobre os poderes das autoridades competentes em definir as normas
bacteriológica e química dos géneros alimentícios e das substâncias neles introduzidas,
assim como regulamentar as matérias tais como rotulagem, marcas ou propaganda dos
géneros alimentícios, tendo sido promulgados regulamentos sobre estas matérias,
incluindo «Colouring Matter in Food Regulations», «The Sweeteners in Food
Regulations», «Food Adulteration (Metallic Contamination) Regulations», etc.
Pelo exposto, durante o decurso da elaboração da Lei de Segurança Alimentar, para
além de identificar as matérias que carecem de melhoramento nos actuais diplomas
legais relativos à segurança alimentar, é preciso ter como referência os Manuais
publicados pela Organização das Nações Unidas para a Alimentação e a Agricultura e a
Organização Mundial de Saúde e as experiências avançadas das outras regiões, de modo
a que a Lei de Segurança Alimentar não só está adequada à realidade da RAEM,
articula-se também com os sistemas de prevenção e controlo dos incidentes de

segurança alimentar a nível internacional e inter-regional, cimentando, deste modo, uma
base sólida para colaboração entre a RAEM e as organizações internacionais ou outros
países e regiões no âmbito de segurança alimentar.

II. Prevenção e controlo dos incidentes de segurança alimentar
1. Criação do mecanismo de monitorização e avaliação dos riscos da
segurança alimentar
Como se sabe, a esmagadora maioria dos géneros alimentícios disponibilizados nos
mercados de Macau, designadamente, os géneros alimentares frescos, tais como carnes,
aves, mariscos, vegetais, etc. são importados de outras regiões, sendo pouco relevante a
percentagem dos géneros alimentícios de origem local no total do comércio. Para
garantir a segurança e qualidade dos géneros alimentícios frescos, o IACM tem vindo a
monitorizar, através do controlo sanitário e fitossanitário4
Da análise do directo comparativo constatou-se que nos países ou regiões vizinhos
há normas reguladoras sobre a avaliação de riscos. Como por exemplo, nos termos da
Lei de Segurança Alimentar do Interior da China, o estado institui o sistema de
, os géneros alimentícios
frescos importados. Apesar disso, ainda existem riscos de contaminação ou deterioração
dos géneros alimentícios frescos nos segmentos da cadeia de circulação, como por
exemplo, nas fases de distribuição, venda a retalho, etc. Acresce que é indispensável a
regular fiscalização sobre os microrganismos, contaminantes, aditivos e afins nos
alimentos, susceptíveis de causar riscos ao corpo humano e ainda o cumprimentos das
normas de segurança alimentar. Neste contexto, é muito importante o estabelecimento
do mecanismo de monitorização e avaliação, global e continuada, dos riscos na
segurança alimentar

avaliação de risco sobre os géneros alimentícios, criando uma comissão de peritos,
composta por especialistas nos domínios de medicina, agricultura, géneros alimentícios
nutrição, etc., para avaliação de risco dos géneros alimentícios. Os resultados dessa
avaliação servem como fundamento científico para definição e revisão de critérios de
segurança alimentar e a implementação de fiscalização e controlo sobre esta matéria.
Em Hong Kong, compete ao Centro de Segurança Alimentar dependente do Food and
Environmental Higiene Department efectuar estudos laboratoriais dos riscos alimentares
e dos nutrientes, ensaios por amostragem relativos aos géneros alimentícios em três
níveis, i.e., importação, distribuição e venda à retalho, ensaios microbiológicos e
químicos, aconselhamento sobre critérios de segurança alimentar com base no resultado
da avaliação de riscos local e experiências passadas ao nível internacional.
Dado que Macau ainda não dispõe de um mecanismo completo de avaliação de
risco dos géneros alimentícios, propõe-se que, tendo em conta que os documentos
publicados pelas organizações internacionais e os diplomas legais das regiões vizinhas
na área da segurança alimentar, propõe-se que, ao legislar sobre a segurança alimentar,
seja expressamente consagrada na Lei de Segurança Alimentar a criação de mecanismo
de monitorização e avaliação dos géneros alimentícios na RAEM, o estabelecimento de
um mecanismo de monitorização e avaliação dos géneros alimentares, incumbido de
realização de ensaios de amostragem de géneros alimentícios de diversa natureza,
análise das informações relativas à segurança alimentar tanto locais como do exterior, e
ainda avaliação dos níveis de risco dos géneros alimentícios, lançando, deste modo, a

base científica para a fixação de critérios e segurança alimentar e adopção de medidas
de gestão de risco.
2. Fixação de normas de segurança alimentar
No decurso da fiscalização e controlo quotidiano ou resposta aos incidentes no
âmbito de segurança alimentar, as autoridades competentes actuam em função dos
resultados das análises das amostras recolhidas, adoptando as correspondentes medidas
de resposta em casos de não satisfação das normas de segurança, medidas essas cujos
graus de severidade variam conforme a gravidade do excesso dos limites. Nestes termos,
evidencia-se a importância das normas de segurança alimentar no mecanismo de
avaliação e controlo de riscos.
Pelo exposto, as legislações das regiões vizinhos têm consagrado as disposições
relativas às normas de segurança alimentar, estabelecendo as normas alimentares em
actos normativos, como por exemplo, a Lei de Segurança Alimentar do Interior da
China dispõe assim: As normas de segurança alimentar têm carácter de execução
mandatária. Compete ao Departamento de Administração de Saúde do Conselho de
Estado a formulação e promulgação das específicas normas nacionais de segurança
alimentar, que comportam, designadamente, as disposições sobre os limites dos
microrganismos patogénicos, resíduos de pesticida, resíduos dos medicamentos
Veterinários, metais pesados, contaminantes e outras substâncias nocivas à saúde
humana nos géneros alimentícios e produtos relacionados com os alimentos; categorias,
âmbito de utilização e dosagem dos aditivos alimentares; exigências de rótulas, marcas e

instruções sobre a segurança e nutrição e condições higio-sanitárias na produção e
exploração alimentar5. A legislação de Hong Kong «Public Health and Municipal
Services Ordinance» dispõe que as autoridades competentes podem regulamentar sobre
a composição de alimentos, normas bacteriológica e química e utensílios destinados
para a preparação e conservação dos géneros alimentícios, assim como a rotulagem,
marcas ou publicidade dos géneros alimentícios, como por exemplo, «Colouring Matter
in Food Regulations», «The Sweeteners in Food Regulations», «Food Adulteration
(Metallic Contamination) Regulations»6
No plano internacional, a Organização das Nações Unidas para a Alimentação e a
Agricultura e a Organização Mundial de Saúde instituiram, nos anos 60 do século
passado, a Comissão do Codex Alimentários, cujo propósito é a definição de normas
alimentares e a publicação do Codex Alimentarius, para servirem ao Mundo como
modelo e referências das normas de segurança alimentar, assim como a prestação de
aconselhamento aos directores-gerais das duas Organizações supracitadas sobre os
planos de execução das normas alimentares. O Codex Alimentarius tem um conteúdo
rico e vasto, abrangendo os temas relacionados com as normas de segurança alimentar,
tais como o uso de aditivos alimentares, a inspecção de géneros alimentícios importados
e exportados, os critérios microbiológicos dos géneros alimentares e normas das
substâncias nucleares e radioactivos, etc., bem como as normas de operações sanitários
em estabelecidos de produção e exploração de géneros alimentícios, visando
, etc.

proporcionar orientações para produção segura e apropriado consumo de géneros
alimentícios7
Nos termos da legislação vigente em Macau, no caso de incumprimento das
exigências de higiene, salubridade e segurança alimentar, ou de as mercadorias não
terem sido aprovadas no controlo sanitário ou fitossanitário, podem ser aplicadas,
designadamente, as seguintes medidas, como por exemplo, a proibição de entrada das
mercadorias, devolução das mercadorias ao local de origem e destruição. Ademais, se a
autoridade sanitária, no exercício das suas funções de prevenção de doenças, verificar
situações susceptíveis de ameaçar ou prejudicar a saúde humana nos estabelecimentos
de fornecimento de géneros alimentícios, pode adoptar as medidas adequadas para
efeitos de prevenção ou repressão. Não obstante os determinados poderes atribuídos
pela lei aos serviços públicos para tomar medidas adequadas à prevenção ou redução
dos riscos de deflagração de incidentes ligados à segurança alimentar, actualmente a lei
vigente não dispõe de normas microbiológicas, químicas e de outros contaminantes nos
géneros alimentícios, o que constitui um obstáculo para as autoridades competentes
efectuarem eficazmente a fiscalização e controlo da segurança alimentar.

Considerando que a definição das normas de segurança alimentar representam uma
peça vital para todo o sistema de prevenção e controlo de segurança alimentar, e
havendo na actual legislação uma insuficiência relativa a esta matéria, propõe-se que a
Lei de Segurança Alimentar disponha expressamente sobre a necessidade da fixação de

normas de segurança alimentar e que sejam publicas, por meio de actos normativos, as
normas de segurança alimentar adequadas à realidade de Macau.
3. Controlo dos géneros alimentícios por rastreabilidade
A alimentação de Macau depende essencialmente da importação, sendo que os
grossistas importam os géneros alimentícios a partir dos lugares de origem, vendendo-os
aos outros distribuidores que, por sua vez, os encaminham para os consumidores finais.
Quando surgirem géneros alimentícios que tiverem problemas de segurança alimentar,
com os actuais mecanismos é difícil rastrear e identificar a fonte desses alimentos.
Para assegurar o apuramento da fonte dos géneros alimentícios aquando de
surgimento de problemas de géneros alimentícios e facilitar a rastreabilidade das fontes
de problemas por parte dos serviços competentes, há numerosos países ou regiões
criaram o mecanismo de rastreabilidade dos géneros alimentícios, como por exemplo, a
Lei de Segurança Alimentar promulgada no passado mês de Abril em Hong Kong que
dispõe sobre o regime de registo dos importadores e distribuidores de géneros
alimentícios, de modo a que as autoridades possam identificar e contactar, de uma forma
célere, os operadores dos géneros alimentícios, procedendo a controlo e gestão em
tempo útil. Nestes termos, propõe-se que, tendo como referência as experiências de
Hong Kong e demais regiões, seja consagrado na Lei de Segurança Alimentar em
elaboração a criação do mecanismo de rastreabilidade dos géneros alimentícios, o
registo dos importadores e distribuidores dos géneros alimentícios, o reforço da
fiscalização e controlo quanto às fontes e definição dos sujeitos de responsabilidade,

possibilitando a rastreabilidade e identificação atempada das fontes dos géneros
alimentícios.
Para estabelecer mecanismos eficientes de gestão dos géneros alimentícios por
rastreabilidade não basta o reforço da supervisão e controlo por parte do Governo nesta
área, sendo de importância vital a colaboração e apoio dos sectores de géneros
alimentícios, como por exemplo, a conservação das facturas ou registos de importação,
garantia de importação por canais legítimos e satisfação das exigências higio-sanitárias
dos alimentos, etc. colaboração pró-activa com as autoridades competentes na gestão
por rastreabilidade e cumprimento rigoroso do dever de protecção da segurança dos
géneros alimentícios.
4. Controlo sanitário e inspecção de géneros alimentícios
4.1 Controlo sanitário
Sendo os géneros alimentícios de Macau essencialmente importados do Interior da
China ou do estrangeiro, os géneros alimentícios frescos, nos termos do Regulamento
Administrativo n.º 40/4004 «Controlo Sanitário e Fitossanitário», estão sujeitos a
verificação por amostragem nos postos fronteiriços ou nos mercados de distribuição, a
fim de assegurar o higiene e segurança dos géneros alimentícios frescos destinados para
o consumo público. Visto que o controlo desses géneros alimentícios importados já está
regulamentado e implementado com eficácia, a futura Lei de Segurança Alimentar não
vai introduzir alterações substanciais nesta parte.

4.2 Inspecção de géneros alimentícios
Para além dos géneros alimentícios frescos, há ainda outros géneros alimentícios,
pré-embalados ou não, de mais variados tipos e em grande quantidade, que afectam a
segurança alimentar de uma forma mais ampla. Ao abrigo do Decreto-Lei n.º 50/92/M,
relativo à Rotulagem dos Géneros Alimentícios e da Lei n.º 6/96/M «Regime jurídico
das infracções contra a saúde pública e contra a economia», compete à Direcção dos
Serviços de Economia fiscalizar o cumprimento do disposto da lei no tocante à
rotulagem dos géneros alimentícios pré-embalados ou não, e o género alimentício
anormal destinado para o consumo público, assim como aplicar sanções aos infracções.
Contudo, na legislação vigente não está previsto um mecanismo de controlo de natureza
permanente sobre os referidos géneros alimentícios. Quando se verificarem problemas
com géneros alimentícios, adoptam-se geralmente os meios de sanção após o facto.
Nestes termos, propõe-se que na Lei de Segurança Alimentar seja criado um
mecanismo de inspecção e controlo de géneros alimentícios, que funciona
permanentemente, de harmonia com os dados resultantes da avaliação e monitorização
de risco, e que procede, de uma forma continuada, à recolha de amostra e análise ou a
inspecção especial dos géneros alimentícios à venda nos mercados, a fim manter-se
constantemente a par das informações dos géneros alimentícios e detectar os riscos da
segurança alimentar.

5. Clarificação das competências de supervisão sobre a segurança
alimentar
Como foi exposto, o controlo dos géneros alimentícios nas suas diversas fases, tais
como produção, transformação, importação, venda, etc. é feito por divisão do trabalho e
sinergias entre os vários serviços funcionais, designadamente, o IACM, a DSE, a DST e
DSS, sendo a distribuição das respectivas tarefas feita de seguinte maneira:
(1) Compete à DSE o licenciamento dos estabelecimentos de produção e
transformação de géneros alimentícios e de bebidas, fiscalização do
cumprimento das disposições de rotulagem dos géneros alimentícios
pré-embalados ou não, assim investigação dos actos criminosos, tais como a
produção, importação, transporte, venda de géneros alimentícios anormais;
(2) Cabe ao IACM efectuar o controlo sanitário e fitossanitário aos géneros
alimentícios a importar; tomar as correspondentes medidas, no caso de
incumprimento das exigências de higiene, salubridade e segurança alimentar,
ou de as mercadorias não terem sido aprovadas no controlo sanitário ou
fitossanitário; prevenir a entrada e circulação, nos mercados de Macau, dos
géneros alimentícios frescos que tiverem problemas; supervisionar as casas de
pasto classificados como os estabelecimentos de comidas e bebidas mediante o
procedimento de licenciamento, efectuando a fiscalização, in loco, do
cumprimento das disposições legais, designadamente o disposto relativo à
higiene e limpeza;

(3) A DST assegura o licenciamento dos estabelecimentos de comidas e bebidas
classificados como restaurantes, salas de dança e bares e a fiscalização se estes
satisfaçam as exigências da segurança, higiene, etc., assim como aplicação de
sanções: advertências, multa e encerramento do estabelecimento e exigência
aos responsáveis dos estabelecimentos para efectuar a regularização e a
limpeza dentro de um prazo determinado, no caso de não satisfação dos
requisitos;
(4) Como um serviço público que assegura o sistema medicinal local, os Serviços
de Saúde têm competência de exercer os poderes de autoridade sanitária,
tomando as medidas adequadas para prevenir e eliminar as situações que
ameacem ou prejudiquem a saúde da população, para além de prestar
assistência aos indivíduos com intoxicação alimentar ou doença de origem
alimentar.
Conforme se constata, os serviços públicos de supervisão, no desempenho das suas
atribuições e com os mecanismos de sinergia entre os serviços públicos, asseguram a
fiscalização dos géneros alimentícios em todas as fases da cadeia alimentar, desde a
importação até ao fornecimento ao consumidor final, e a prevenção da ocorrência de
incidentes de segurança alimentar. No entanto, verificam-se ainda espaços para
melhoramento nos actuais mecanismos, como por exemplo, a falta de indicação clara,
na legislação, sobre qual é o serviço competente para efectuar análises dos géneros
alimentícios disponibilizados nos mercados, ou qual é o serviço incumbido de

fiscalização dos estabelecimentos que vendem géneros alimentícios sem necessidade da
obtenção do licenciamento.
Nestes termos, o projecto da Lei de Segurança Alimentar propõe que, sem prejuízo
das competências atribuídas aos outros serviços públicos, o IACM passe a ter
competências para efectuar recolha de amostras e análises e aplicar multas e demais
sanções acessórias correspondentes às infracções. Ademais, com vista a dar resposta
pronta e eficaz aos incidentes de segurança alimentar, o IACM pode, consoante as
circunstâncias específicas, adoptar ou fazer adoptar diversas medidas, tais como retirada,
proibição de vendas ou destruição dos géneros alimentícios, ou ainda limpeza ou
desinfecção obrigatórias das instalações, entre outras.
6. Medidas de controlo da segurança alimentar
A fim de prevenir a ocorrência de incidentes de segurança alimentar e, no caso de
ocorrência, controlar a zona de influência, é necessário dotar aos serviços competentes
as atribuições para tomada de medidas de controlo, por forma a enfrentar as situações
que impliquem ameaça ou risco à segurança alimentar.
6.1 Medidas de controlo dos géneros alimentícios
Nas fases de produção, venda e circulação dos géneros alimentícios, se forem
detectados casos de não satisfação dos requisitos higio-sanitários ou incidentes de
segurança alimentar, devem ser tomadas medidas para impedir a entrada desses

produtos nos mercados ou a sua continuação de venda, de modo a evitar a ocorrência de
incidentes de segurança alimentar ou o alargamento de influências dali resultantes.
Nestes termos, convém conferir aos serviços competentes os poderes adequados
para tomar conta das situações de uma forma oportuna e adequada. A título
exemplificativo, a determinação de retirada ou recolha de géneros alimentícios é uma
medida importante para salvaguarda da segurança alimentar. Além disso, as medidas de
controlo, tais como ordenar a proibição de importação de determinados géneros
alimentícios por um certo período de tempo; determinar que certos géneros alimentícios
sejam apreendidos, isolados ou destruídos e proibir a realização de actividades
relativas a determinados géneros alimentícios são muito importantes para a prevenção
de incidentes de segurança alimentar. Por isso, propõe-se que sejam consagradas na Lei
de Segurança Alimentar as seguintes medidas de controlo sobre géneros alimentícios:
(1) Retirada de géneros alimentares;
(2) Limitação ou proibição da venda de géneros alimentares;
(3) Proibição da importação de géneros alimentares;
(4) Apreensão ou destruição dos géneros alimentícios, etc.

6.2 Medidas de controlo dos estabelecimentos
A satisfação ou não dos critérios higio-sanitários e de segurança alimentar constitui
um dos factores que afectam directamente a saúde pública e a segurança alimentar
depende indirectamente do cumprimento ou não das exigências de higiene dos
estabelecimentos da sua produção, armazenamento e venda, pelo que é necessário
fiscalizar o cumprimento do disposto relativo á sanidade ambiental mediante as vistoria
e inspecção.
Como foi referido, os estabelecimentos de produção e exploração de géneros
alimentícios existentes em Macau regem-se pelo disposto nos respectivos diplomas
legais. Como por exemplo, nos termos do decreto-lei n.º 16/96/M, compete à Direcção
dos Serviços de Turismo o licenciamento e a inspecção dos restaurantes, classificados
como estabelecimentos similares do Grupo 1, cabendo ao Instituto para os Assuntos
Cívicos e Municipais o licenciamento e a inspecção das casas de pasto e lojas de sopa de
fitas e canjas e afins, qualificados como estabelecimentos similares do Grupo 5 e sendo
de responsabilidade da Direcção dos Serviços de Economia o licenciamento e a
inspecção de estabelecimentos de produção e transformação de géneros alimentícios. Os
serviços de supervisão procedem a licenciamento desses estabelecimentos, baseando-se
no cumprimento do disposto na lei quanto às condições higio-sanitárias. Se os
estabelecimentos tiverem problemas ou incidentes de segurança alimentar devido à falta
de condições higio-sanitárias, aos serviços de supervisão compete adoptar medidas nos
termos da legislação vigente, como por exemplo, encerramento dos estabelecimentos.

Quando o IACM tiver sido dotado de competência específica para lidar com a
segurança alimentar, passaria a adoptar medidas necessários, de modo a poder controlar
a situação em tempo útil, no exercício das suas atribuições no âmbito de segurança
alimentar, i.e., fiscalizar se os géneros alimentícios produzidos ou explorados pelos
restaurantes satisfaçam os critérios higio-sanitários e de segurança alimentar. No caso de
detectar falta das condições higio-sanitarias ou ameaça à segurança alimentar nesses
estabelecimentos, o IACM notificará, por um lado, à entidade pública de licenciamento
para dar seguimento no âmbito das suas atribuições e, por outro, procederá, nos termos
da Lei de Segurança Alimentar, a adoptar as seguintes medidas de controlo sobre os
estabelecimentos:
(1) Limpeza e desinfecção de obras, instalações ou equipamentos;
(2) Melhoramento de instalações ou equipamentos;
(3) Encerramento provisório do estabelecimento, etc.
6.3 Medidas de proibição de géneros alimentícios
Nos termos do Regulamento Administrativo n.º 40/2004 «Controlo sanitário e
fitossanitário», no caso de incumprimento das exigências de higiene, salubridade e
segurança alimentar, ou as mercadorias não terem sido aprovadas no controlo sanitário
ou fitossanitário, podem ser aplicadas, designadamente, as seguintes medidas, i.e.,
proibição de entrada das mercadorias ou devolução das mercadorias ao local de origem.
Ademais, nos termos da Lei n.º 7/2003 «Comércio Externo», o Chefe do Executivo

pode, por razões de protecção da vida, da saúde ou da segurança das pessoas, proibir a
importação, exportação de determinadas mercadorias. Embora na actual legislação já
atribui às autoridades administrativas o poder de proibir a importação de determinadas
mercadorias, com o intuito de melhor definir a responsabilidade de garantir a segurança
alimentar, a Lei de Segurança Alimentar deixará bem clara que, a fim de proteger a vida
e saúde da população, as autoridades competentes podem ordenar a proibição de
importação ou exportação desses géneros alimentícios, , em casos de suspeita
fundamentada de quaisquer riscos de segurança.
7. As acções de fiscalização
Para efeitos de prevenção de incidentes e eliminação de riscos no âmbito de
segurança alimentar, é indispensável a fiscalização quotidiana. Actualmente, cabe às
entidades da concessão de licença de restaurantes ou estabelecimentos industriais de
géneros alimentícios a fiscalização do cumprimento das disposições legais relativas às
condições ambiental e higiênica, assim como a aplicação de sanções e adopção de
medidas, em casos de não satisfação dos requisitos previstos na lei. No futuro,
reforçar-se-á a fiscalização e controlo de segurança alimentar, cabendo ao IACM
efectuar a fiscalização. Se se verificar o incumprimento das disposições legais ou
critérios higio-sanitários, o IACM, para além de aplicar as correspondentes sanções nos
termos da Lei de Segurança Alimentar, notificará as entidades de supervisão, de modo a
aplicar demais sanções aos estabelecimentos infractores, se for o caso. Por isso, o IACM

passará a efectuar sistematicamente inspecções conjuntas em articulação com demais
serviços de supervisão, com vista a um melhor controlo sobre a segurança alimentar.
De resto, aquando da fiscalização efectuada pelas autoridades competentes, os
responsáveis dos estabelecimentos devem prestar colaboração, facultando os agentes de
fiscalização o apoio necessário para o desempenho das suas funções, sob pena de
incidirem no crime de desobediência.
8. Mecanismo de gestão de incidentes da segurança alimentar
Para prevenir eficazmente a ocorrência da incidentes de segurança alimentar, o
Governo da RAEM criou, em 2008, o “Grupo de Coordenação sobre a segurança dos
produtos alimentares” que visa coordenar a fiscalização da segurança dos produtos
alimentares e efectuar uma gestão oportuna e adequada dos incidentes de segurança
alimentar. Na legislação vigente não está previsto um mecanismo específico para lidar
com situações de emergência desta natureza, não havendo um plano previamente
definido, que permita uma coordenação operacional das acções dos serviços públicos
para fazer frente a essas ocorrências. No Interior da China, a Lei de Segurança
Alimentar tem um capítulo dedicado para lidar com incidentes de segurança alimentar,
no qual dispõe que caiba ao Conselho de Estado a formulação do plano de resposta à
emergência de segurança alimentar.
Portanto, para possibilitar uma resposta célere aos incidentes de segurança
alimentar, e tendo como referência as práticas do Interior da China e de outras regiões, a

Lei de Segurança Alimentar definirá claramente um mecanismo de tratamento dos
incidentes de segurança alimentar. Ademais, propõe-se a formulação do plano de
respostas às situações de emergência no âmbito de segurança alimentar, o
estabelecimento de mecanismo e respectivas medidas em função da natureza e da
gravidade dos incidentes, bem como a criação de uma Comissão de Segurança
Alimentar, de nível mais elevado, incumbida de tratar dos incidentes de segurança
alimentar mais relevantes, habilitado para activar o mecanismo de segurança alimentar
de acções conjuntas dos serviços públicos pertencentes a diversas áreas governativas, de
modo a efectuar resposta oportuna, célere e eficiente.
9. Divulgação e comunicação sobre a segurança alimentar
A par da avaliação e gestão de riscos, a comunicação de risco também constitui
também uma parte chave do sistema estratégico da segurança alimentar. Na verdade,
trata-se de um procedimento muito eficaz para reduzir os riscos de segurança alimentar,
nos casos em que se efectua uma regular troca ou intercâmbio de informações quanto à
gestão de segurança alimentar com outros serviços públicos competentes ou
organizações internacionais, assim como a atempada divulgação ao público das
informações de segurança alimentar, em relação à quais se incentiva o feedback dos
operadores dos sectores relacionados. No âmbito de gestão interna sobre a segurança
alimentar, a comunicação entre os serviços funcionais também é muito importante, dado
que um intercâmbio de informações relativas aos riscos de segurança alimentar
contribui muito positivamente para uma eficiente prevenção de incidentes de segurança

alimentar. De resto, a divulgação, junto da população, do conhecimento sobre a
prevenção de intoxicação alimentar ou doenças de origem alimentar e a sensibilização
do público para melhor conhecer e enfrentar os incidentes de segurança pública de
diversa natureza contribuem para salvaguarda eficaz da saúde pública e prevenção de
ocorrência de pânicos desnecessários.
Por isso, no projecto da Lei de Segurança Alimentar recomenda-se que o IACM
seja dotado de atribuição para desenvolver acções de informação e educação de
segurança alimentar, através das actividades públicas, palestras informativas, emissão de
instruções, etc., reforçar a comunicação entre os diferentes sectores e quadrantes da
RAEM no domínio de segurança alimentar, mediante a transmissão atempada de
mensagens por diversos meios de comunicação social, e ainda efectuar comunicação e
intercâmbio de informações relativa à segurança alimentar aos serviços competentes das
regiões vizinhas utilizando ao mecanismo de ligação.

III. Regime sancionatório
1. Responsabilidade criminal
Nos termos das leis vigentes em Macau, os actos que põem em risco a segurança
alimentar são qualificados como infracções criminais. Como por exemplo, o artigo 269.º
do Código Penal dispõe o seguinte: o facto de na produção, fabrico, embalagem,
transporte, tratamento ou outra actividade que sobre elas incida, de substâncias
destinadas a consumo alheio, para serem comidas, mastigadas, bebidas, as corromper,
alterar, falsificar ou reduzir o seu valor nutritivo, e criar deste modo perigo para a vida
ou perigo grave para a integridade física de outrem, constitui crime; outrossim, o artigo
20.º da Lei n.º 6/96/M, «Regime jurídico das infracções contra a saúde pública e contra
a economia» reza assim: quem produzir, fabricar, transportar, armazenar, vender, ou
importar, para consumo público, géneros alimentícios ou aditivos alimentares anormais
não susceptíveis de criar perigo para a vida ou grave perigo para a integridade física de
outrem, pratica um crime e é punido criminalmente.
Atendendo ao facto de que a actual legislação já prevê a responsabilidade criminal
das pessoas que põem em risco a segurança alimentar, convém, ao elaborar a Lei da
Segurança Alimentar, aprofundar os estudos sobre se as disposições vigentes são
suficientemente englobantes e efectuar análises sobre se as sanções vigentes relativas à
segurança alimentar produzem suficientes efeitos dissuasores.

2. Infracções administrativas
Propõe-se que sejam qualificados como infracções administrativas os actos que
representam ameaça à saúde pública sem contudo atingir o grau de tornar-se um crime,
como por exemplo, os actos de produção, exploração, transporte, importação ou
exportação de géneros alimentícios que não satisfaçam as exigências de segurança
alimentar, sem causarem risco à saúde pública. Daí resulta que competiria aos serviços
competentes intervir neles e aplicar sanções. Quanto à infracções criminais previstas na
Lei da Segurança Alimentar e relacionadas com a segurança alimentar, às quais
correspondem sanções ligeiras, como por exemplo, infracções puníveis só com pena de
multas, é conveniente ponderar a hipótese de integrá-los na categoria de infracções
administrativas, passando a competir aos órgãos administrativos sancioná-las, evitando,
deste modo, os trâmites de julgamento no tribunal, reduzindo a demora processual e
elevando a eficiência na implementação da lei.
