1. EMENTA

Análise das estruturas internacionais de Direitos Humanos e sua relação com as

estruturas de direito interno com vistas à efetivação de políticas de implementação de

direitos. Nesse sentido, a disciplina traz a debate o desenvolvimento econômico e seu

diálogo com a efetivação de direitos humanos. As normas vetores desses direitos

permitem que alterações internas possam ser objeto de análise por órgãos

internacionais. Nova configuração da Soberania tendo em vista proteção de direitos e

desenvolvimento econômico. Estudo de como o direito pode ser criado e protegido a

partir das estruturas internacionais, tanto global, quanto regionais.

2. JUSTIFICATIVA DA DISCIPLINA

A importância da proteção dos direitos humanos para o desenvolvimento econômico

repousa na necessidade de se pensar em elementos ligados à distribuição de renda,

proteção ambiental, acesso a políticas de saúde e educação, entre outras políticas

públicas. Nesse sentido, reconhecer que a luta interna por poder tende a trazer

consequências negativas para as minorias. Logo, as estruturas internacionais podem

servir, em países democráticos, para reafirmar e relembrar seus compromissos com os

direitos humanos e com o desenvolvimento econômico. É comum se identificarem

momentos de desenvolvimento econômico em cenários de não proteção dos direitos

humanos, como em países totalitários ou não ligados à preservação ambiental. Os

sistemas internacionais de proteção dos direitos humanos permitem que se tenha um

medidor de desafios do país, em especial quando analisada a Revisão Periódica

Universal (RPU) do Conselho de Direitos Humanos da ONU.


3. OBJETIVOS

3.1. Geral: Aprofundar com estudantes de Mestrado e Doutorado o funcionamento dos

sistemas internacionais de Direitos Humanos e relacioná-los com o desenvolvimento

econômico.

3.2. Específicos: A disciplina objetiva analisar, de forma crítica, o diálogo entre direito

interno e direito internacional a partir dos sistemas de Direitos Humanos e seus reflexos

no desenvolvimento econômico. Para tanto, serão analisadas decisões de órgãos da

ONU e dos Sistemas Regionais (mormemente Europeu e das Américas).

4. AVALIAÇÃO

O método utilizado para avaliação será composto pela participação em sala de aula, com

peso 2, por apresentação dos casos indicados em seminários em grupos de, no máximo,

3 pessoas, com peso 3, e a entrega de um artigo científico, com peso 6, a ser entregue na

penúltima semana de aula.

A nota final será a média extraída das 3 formas de avaliação, com seus respectivos

pesos. A nota mínima que dispensa o aluno de exame é igual ou superior a 5,0 (cinco).

5. CONTEÚDO PROGRAMÁTICO

Os principais tópicos a serem abordados serão: Direito dos Estrangeiros e

Nacionalidade – origens históricas no Brasil e no mundo. A evolução do tratamento

internacional da nacionalidade. A nacionalidade e os direitos fundamentais. O

regramento constitucional e legal da nacionalidade no Brasil. A Economia e a migração.

O Direito Internacional Privado e a Nacionalidade. Os direitos adquiridos. Os tratados

internacionais, a condição jurídica do apátrida e a polipatria. O Direito Internacional

Privado e a Nacionalidade – de Mancini aos dias atuais. O estrangeiro e a imigração. A

entrada e permanência: os direitos. A saída dos estrangeiros. A proteção: institutos e

órgãos. Refugiados e seu regime jurídico. O papel do sistema internacional de proteção

de direitos humanos. Análise de casos envolvendo nacionalidade e condição jurídica de

estrangeiros. Perspectivas: a nacionalidade na globalização e os novos estrangeiro. Os

impactos econômicos da migração. O direito de ingresso do estrangeiro e as escolhas

trágicas governamentais. Os expatriados empresariais.


6. METODOLOGIA

As aulas teóricas terão caráter expositivo-dialógico, compostas de debates a partir de casos indicados no

cronograma, com ênfase na estrutura dialogada. Os casos serão expostos pelos alunos seguidos de

apresentação por parte do Professor e debates entre os alunos. Durante as aulas poderão ser utilizados

aparelhos audiovisuais.
